These Terms of Service ("Terms") govern your access to and use of the website located at aduconstruction.top (the "Site") and any content, features, or services provided through the Site. The Site is operated by ADU Construction ("we," "us," "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site. If you use the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Site. By using the Site, you represent and warrant that you meet these requirements.

The Site and its entire contents, features, and functionality — including all text, graphics, logos, images, photographs, illustrations, floor plans, architectural drawings, data compilations, and software — are owned by ADU Construction, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.
The ADU Construction name and logo are trademarks of ADU Construction. You may not use these marks without our prior written permission.
Photos of completed projects are the property of ADU Construction or are used under license from the photographers or clients. You may not reproduce them without written consent.
When you submit information to us through the Site — for example, through a contact form, appointment request, or job application — you represent and warrant that the information is accurate, that you have the right to submit it, and that its submission does not violate any third party's rights.
You grant us a non-exclusive, worldwide, royalty-free license to use the information you submit to respond to your inquiry, prepare a quote or contract, deliver our services, and otherwise operate our business as described in our Privacy Policy. We do not claim ownership over the personal information you submit.
You agree not to submit any content that is unlawful, defamatory, obscene, threatening, invasive of privacy, or otherwise objectionable.
The information on this Site — including cost ranges, timelines, and project descriptions — is provided for general informational purposes only. Your specific project will be governed exclusively by your signed construction contract, which will contain the actual scope, price, and schedule for your project.
Construction contracts with ADU Construction are governed by California law, including the Contractors State License Board requirements and applicable provisions of the California Business and Professions Code and Civil Code.
Any estimate, cost range, or pricing information displayed on the Site is a general estimate for planning purposes only and is not a binding quote. Binding pricing is provided only in a written proposal or contract signed by both parties.
Actual project costs depend on many factors that cannot be fully determined without a site assessment, including site conditions, local permitting requirements, material availability, and your design selections. Cost ranges published on the Site reflect typical projects in California but may not apply to your specific property.
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any information on the Site is complete, accurate, or current.
Separately, the warranty on any construction work we perform for you is governed by your construction contract and our Warranty page. The disclaimers in this section do not limit the construction warranty in your contract.
To the fullest extent permitted by law, ADU Construction, its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to your use of the Site is limited to one hundred US dollars ($100). This limitation does not apply to any claim arising under a separate signed construction contract, which is governed by the terms of that contract.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations above may not apply to you. In that case, our liability is limited to the maximum extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless ADU Construction and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit to the Site.
The Site may contain links to third-party websites or resources that are not owned or controlled by ADU Construction. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party site. You acknowledge and agree that ADU Construction is not responsible or liable for any damage or loss caused by or in connection with your use of any such third-party site.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Site that is not subject to the arbitration provision below will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
Before filing any legal action arising out of or related to these Terms or the Site, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
If the dispute is not resolved informally, either party may elect to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the arbitration taking place in San Francisco, California. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
Class action waiver. To the fullest extent permitted by law, all disputes will be resolved on an individual basis and not in a class, consolidated, or representative action.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of ADU Construction.
We may revise these Terms from time to time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after any change constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
